Welcome to FundXYZ. These Terms of Service ("Terms") constitute a legally binding agreement between you and FundXYZ ("Company," "we," "our," or "us") governing your access to and use of our website, mobile application, tokenized investment platform, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use our Services.

Definitions

  • "$FXYZ Tokens" refers to the digital tokens issued by the Company that represent proportional ownership in the FundXYZ investment portfolio.
  • "Content" means any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Services.
  • "User," "you," or "your" refers to individuals who access or use the Services.
  • "Investment Portfolio" refers to the collection of assets managed by FundXYZ.

Eligibility

To access and use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract with us
  • Not be prohibited from using the Services under applicable laws
  • Complete our identity verification and anti-money laundering screening process
  • Be a resident of a jurisdiction where our Services are available

We reserve the right to refuse access to the Services to anyone for any reason at any time.

Account Registration and Security

Account Creation

To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

KYC and AML Compliance

You agree to complete our Know Your Customer (KYC) and Anti-Money Laundering (AML) verification process, which may include providing government-issued identification, proof of address, source of funds documentation, and other information as required by applicable laws and regulations.

$FXYZ Tokens

Token Functionality

$FXYZ tokens represent proportional ownership in the FundXYZ investment portfolio. Each token entitles the holder to:

  • A proportional share of the profits generated by the investment portfolio
  • Governance rights as specified in our governance framework
  • Other benefits as described in our documentation

Token Valuation

The value of $FXYZ tokens is determined by the net asset value of the underlying investment portfolio, market demand and supply dynamics, and performance of the investments. We do not guarantee any specific token value or investment return.

Investment Risks and Disclosures

Risk Acknowledgment

Investing in $FXYZ tokens involves significant risks, including but not limited to:

  • Market risks and volatility
  • Liquidity risks
  • Regulatory and legal risks
  • Technology and security risks
  • Management and operational risks
  • Total loss of investment

You acknowledge that you have been made aware of these risks and that you are investing at your own risk.

Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any portion of the Services
  • Interfere with or disrupt the Services or servers
  • Engage in market manipulation or fraudulent activities
  • Use the Services to launder money or finance terrorism

Limitation of Liability

To the maximum extent permitted by applicable law, FundXYZ and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Indemnification

You agree to indemnify and hold harmless FundXYZ and its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Services or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last Updated" date.
